Novee™ Terms of Sale These Terms of Sale (“Terms”) govern all purchases and subscription bundles that include Novee™ hardware such as smartwatches or other wearable devices (the “Hardware”). By completing a purchase, subscribing to a plan that includes Hardware, or accepting delivery of Hardware, you agree to be bound by these Terms. 1. Orders and Acceptance Your order is an offer to purchase Hardware and/or subscription services from BonCor Medical, LLC (“BonCor”, “we”, or “our”). We reserve the right to accept or reject any order for any reason, including availability, errors in product descriptions, or suspected fraud. A contract is formed only when we send you a confirmation email and/or ship the Hardware. 2. Shipping & Delivery • Orders are typically processed and shipped within 3–5 business days. • Delivery times may vary based on your destination and carrier availability. • BonCor is not liable for delays caused by carriers, weather, or events outside our control. • You are responsible for providing accurate shipping details. Lost shipments due to incorrect addresses are your responsibility. 3. Risk of Loss Risk of loss or damage to the Hardware transfers to you upon delivery. You are responsible for the care, safety, and maintenance of the Hardware until it is returned to BonCor (if return is required under our EULA). 4. Returns & Refunds 4.1 Returns of Hardware (General) You may return Hardware within 30 days of delivery if it is in good, working condition (reasonable wear and tear excepted). 4.2 Refund Eligibility • Hardware must be returned in its original or equivalent packaging. • Shipping costs are non-refundable. • BonCor reserves the right to apply a restocking fee for damaged or incomplete returns. 4.3 Subscription Fees Subscription fees are non-refundable once the subscription term begins. 5. Non-Return Fee (If Hardware Is Not Returned) Certain plans require returning Hardware when a subscription ends. Failure to return required Hardware may result in a non-return fee, as described in your subscription terms. 6. Warranty Coverage Hardware is covered by a one-year limited warranty for defects in materials and workmanship under normal use. The full warranty terms are included in the Novee Warranty & Returns Policy. Replacements provided under warranty may be new, refurbished, or remanufactured. 7. Accuracy & Health Disclaimer The Hardware is intended for general wellness and fitness purposes. It is not a medical device, and the data it provides is not intended for diagnosis, treatment, or medical decision-making. 8. Pricing & Taxes • Prices for Hardware and subscription plans are listed on our website and may change at any time. • Applicable taxes will be calculated at checkout. • All prices are in U.S. dollars. 9. Payment Terms Payment is due at the time of your order or at the beginning of each subscription cycle. You authorize BonCor to charge your payment method according to your selected plan. BonCor uses secure third-party payment processors and does not store your credit card information. 10. Limitation of Liability To the fullest extent permitted by law, BonCor is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your purchase or use of Hardware. Our total liability will not exceed the amount you paid for the Hardware. 11. Governing Law These Terms are governed by the laws of the State of Michigan. Any disputes will be resolved exclusively in the state or federal courts located in Detroit, Michigan. 12.
